These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you") and TennoTenRyu Inh. Cesarano ("AIM", "we", "us"), registered in Zug, Switzerland (CHE-272.196.618), for access to and use of the AIM — AI Marketing service ("Service").
By subscribing to any AIM plan, submitting your domain for analysis, or using any part of the Service, you confirm that you have read, understood, and agree to these Terms.
AIM provides AI-assisted marketing services including, but not limited to:
Specific deliverables per plan are described on the pricing page at aim.cesaranogilbert.com/#pricing. AIM reserves the right to modify service features with 30 days' written notice.
Payment is charged at the start of each billing period. If a payment fails, AIM will attempt to retry the charge. Persistent payment failure may result in service suspension after 7 days' notice.
AIM offers a 14-day money-back guarantee for first-time subscribers. To claim a refund, contact info@cesaranogilbert.com within 14 days of your first charge. Refunds are not available after 14 days or for renewals.
You agree to:
You retain all rights to your domain, brand, and existing content. AIM receives a limited licence to publish content to your domain for the duration of the subscription.
All articles, schemas, structured data, and other content created by AIM for your domain become your property upon full payment of the relevant billing period. AIM may use anonymised performance metrics for internal benchmarking.
The AIM platform, agents, algorithms, and proprietary methods remain the exclusive intellectual property of TennoTenRyu Inh. Cesarano. No licence to the underlying technology is granted.
AIM delivers AI-optimised content and technical improvements using proven methodologies. However:
AIM commits to delivering the article volumes and campaigns specified in your plan, within the stated timelines, and to reporting results transparently.
You may cancel your subscription at any time via the billing portal or by contacting info@cesaranogilbert.com. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused days in the current period (except under the 14-day guarantee).
AIM may terminate a subscription immediately if: (a) the client breaches these Terms; (b) the domain is involved in illegal or harmful activities; (c) payment fails after the retry period.
To the maximum extent permitted by applicable law, AIM's total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees paid by you in the 3 months preceding the claim.
AIM is not liable for indirect, consequential, incidental, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless TennoTenRyu Inh. Cesarano, its principals, agents, and affiliates from any claims, damages, or expenses arising from: (a) your use of the Service; (b) your breach of these Terms; (c) the content or nature of your domain or business.
These Terms are governed by the laws of Switzerland, specifically the canton of Zug. The parties agree to attempt to resolve any dispute in good faith within 30 days of written notice.
If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Zug, Switzerland. For EU consumers, mandatory consumer protection provisions of your country of residence remain unaffected.
AIM reserves the right to update these Terms. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
Disclosure required under EU AI Act (Regulation 2024/1689, Art. 50): AIM uses AI systems to generate domain analysis results, content, and recommendations. Where you interact with an AI-powered tool or receive AI-generated output, this is disclosed at the point of interaction.
All domain audits, scores, content briefs, articles, carousels, and recommendations produced by AIM are generated with the assistance of AI language model systems. These outputs are:
Where AIM delivers AI-generated images (carousels, cover images, illustrations) as part of a service deliverable, such images are labeled "AI-generated image" in the delivery. Clients publishing AI-generated images to EU audiences are responsible for ensuring compliance with applicable disclosure requirements in their jurisdiction, including EU AI Act Art. 50(3) where applicable.
AIM does not use AI systems classified as high-risk under Annex III of the EU AI Act (Regulation 2024/1689). The Service does not make automated decisions affecting: employment or workers, access to education, access to credit or essential services, law enforcement, migration, or administration of justice.
Clients must not use AIM outputs as the sole basis for any high-risk decision as defined under EU AI Act Annex III, including but not limited to: HR screening or ranking of natural persons, creditworthiness assessment, or any other use regulated under Annex III. AIM accepts no liability for outputs used in prohibited or high-risk contexts.
