Terms of Service

1. Parties and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you") and TennoTenRyu Inh. Cesarano ("AIM", "we", "us"), registered in Zug, Switzerland (CHE-272.196.618), for access to and use of the AIM — AI Marketing service ("Service").

By subscribing to any AIM plan, submitting your domain for analysis, or using any part of the Service, you confirm that you have read, understood, and agree to these Terms.

2. Service Description

AIM provides autonomous AI marketing services including, but not limited to:

• SEO content creation and technical optimisation
• Generative Engine Optimisation (GEO) for AI citation building
• Answer Engine Optimisation (AEO) including FAQ cluster development
• AI Influence Operations (AIO) including knowledge graph and entity building
• Domain analysis and competitive benchmarking
• Monthly performance reporting

Specific deliverables per plan are described on the pricing page at aim.cesaranogilbert.com/#pricing. AIM reserves the right to modify service features with 30 days' written notice.

3. Subscriptions and Payment

3.1 Plans and billing

• AIM plans are billed monthly in CHF (Swiss Francs) via Stripe
• Ignite: CHF 397/month · Accelerate: CHF 997/month · Dominate: CHF 2,497/month
• Subscriptions auto-renew monthly unless cancelled
• Prices include applicable Swiss VAT where required

3.2 Payment terms

Payment is charged at the start of each billing period. If a payment fails, AIM will attempt to retry the charge. Persistent payment failure may result in service suspension after 7 days' notice.

3.3 Refund policy

AIM offers a 14-day money-back guarantee for first-time subscribers. To claim a refund, contact gilbert@cesaranogilbert.com within 14 days of your first charge. Refunds are not available after 14 days or for renewals.

4. Client Obligations

You agree to:

• Provide accurate domain information and maintain access to the domain throughout the subscription
• Ensure you have the right to optimise and publish content for the submitted domain
• Not use AIM to optimise domains involved in illegal activities, spam, or policy-violating content
• Respond to onboarding communications within 7 business days
• Keep your account credentials secure

5. Intellectual Property

5.1 Client's domain and brand

You retain all rights to your domain, brand, and existing content. AIM receives a limited licence to publish content to your domain for the duration of the subscription.

5.2 AIM-created content

All articles, schemas, structured data, and other content created by AIM for your domain become your property upon full payment of the relevant billing period. AIM may use anonymised performance metrics for internal benchmarking.

5.3 AIM platform and technology

The AIM platform, agents, algorithms, and proprietary methods remain the exclusive intellectual property of TennoTenRyu Inh. Cesarano. No licence to the underlying technology is granted.

6. Results and Guarantees

AIM delivers AI-optimised content and technical improvements using proven methodologies. However:

• AIM does not guarantee specific ranking positions, citation counts, or revenue outcomes
• AI search engine algorithms change frequently; cited timelines are based on historical averages
• Results depend on factors outside AIM's control including domain age, competition, and AI engine policy changes

AIM commits to delivering the article volumes and campaigns specified in your plan, within the stated timelines, and to reporting results transparently.

7. Cancellation

You may cancel your subscription at any time via the Stripe customer portal or by contacting gilbert@cesaranogilbert.com. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused days in the current period (except under the 14-day guarantee).

AIM may terminate a subscription immediately if: (a) the client breaches these Terms; (b) the domain is involved in illegal or harmful activities; (c) payment fails after the retry period.

8. Limitation of Liability

To the maximum extent permitted by applicable law, AIM's total liability to you for any claim arising from these Terms or the Service shall not exceed the total fees paid by you in the 3 months preceding the claim.

AIM is not liable for indirect, consequential, incidental, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless TennoTenRyu Inh. Cesarano, its principals, agents, and affiliates from any claims, damages, or expenses arising from: (a) your use of the Service; (b) your breach of these Terms; (c) the content or nature of your domain or business.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Switzerland, specifically the canton of Zug. The parties agree to attempt to resolve any dispute in good faith within 30 days of written notice.

If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Zug, Switzerland. For EU consumers, mandatory consumer protection provisions of your country of residence remain unaffected.

11. Modifications

AIM reserves the right to update these Terms. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
